ASBESTOS 2027 Terms & Conditions
These Terms and Conditions apply to registration for, admission to and attendance at the ASBESTOS 2027 Conference, including its workshops, social functions, tours and associated activities (the Event). By submitting a registration, accepting a registration made on your behalf, or attending the Event, you agree to these Terms and Conditions.
1. Parties and role of the Conference Manager
The Event is hosted by the Faculty of Asbestos Management of Australia & New Zealand Limited (ABN 14 632 058 229) (FAMANZ or the Host).
The Event is managed by True Synergy Pty Ltd (ABN 63 883 405 386) (Conference Manager), acting as agent for and on behalf of the Host. References to we, us and our mean the Host and, where applicable, the Conference Manager acting for the Host.
All contractual obligations, rights and remedies concerning registration and attendance are those of the Host. The Conference Manager may administer and enforce these Terms and Conditions on the Host’s behalf.
2. Your capacity and acceptance
You enter into this agreement in your personal capacity and, where applicable, for any business or organisation you represent and any guest or other person for whom you register (each a Relevant Person).
You warrant that you have authority to register each Relevant Person, have provided them with these Terms and Conditions, and have their consent to provide their personal information to us.
You must ensure that each Relevant Person complies with these Terms and Conditions. A guest’s admission and continued attendance are conditional on that guest accepting and complying with them.
3. Registration and payment
Registration is not confirmed until we issue written confirmation and receive all amounts due in cleared funds.
Fees are payable in the currency stated on the registration page and include or exclude applicable taxes as specified during registration.
Credit-card payments must be made when registration is submitted. Where an invoice is requested and approved at least 30 days before the Event, payment must be made within 14 days of the invoice date or by any earlier date stated on the invoice.
To retain an early-bird or other discounted rate, full payment must be received by the advertised deadline. Otherwise, the rate available when payment is received will apply.
We may cancel an unpaid registration or refuse admission where payment has not been received in full. On-site and late registrations must be paid immediately by an accepted payment method.
4. Your cancellation and refunds
You may cancel your registration by emailing [email protected]. Cancellation is not effective until we acknowledge it in writing. If you do not receive an acknowledgement within two business days, contact us on +61 3 9989 4234.
If we receive your cancellation before 5.00 pm in the Event time zone more than 60 days before the Event begins, we will refund amounts paid less an administration fee of AUD $150.
If we receive your cancellation between 60 and 30 days before the Event begins, we will refund 50% of the registration fee paid.
If we receive your cancellation fewer than 30 days before the Event begins, or if you do not attend, no refund will be payable.
Refunds will be returned, where practicable, using the original payment method. Bank, foreign exchange and third-party transaction charges are not refundable unless required by law.
5. Transfer of registration
You may request to transfer your registration to another person by emailing us before the Event. The transferee must satisfy any eligibility requirements, provide the information we require and agree to these Terms and Conditions.
Any difference in registration category or fee must be paid before the transfer is confirmed. No refund is payable merely because a registration is transferred. We may charge a reasonable administration fee where advised before processing the transfer.
6. Cancellation, postponement or format change by the Host
The Host may cancel, postpone, relocate or change the format of all or part of the Event where reasonably necessary, including because of circumstances beyond its reasonable control. We will notify registered attendees using the email address supplied during registration.
If the Event is cancelled and not rescheduled, we will refund registration fees paid for cancelled components, except to the extent services or benefits have already been supplied and subject to rights that cannot lawfully be excluded.
If the Event is postponed or materially relocated, your registration will transfer to the revised Event. You may request cancellation within the period specified in our notice if you cannot or do not wish to attend. We will then refund the applicable registration fee paid, except to the extent services or benefits have already been supplied.
If an in-person Event is converted to a virtual or hybrid format, we may transfer your registration to the revised format and provide an appropriate partial refund or credit where the value of the registration is materially reduced.
Unless required by law, we are not responsible for travel, accommodation, visa, loss of income or other expenses arising from cancellation, postponement, relocation or a format change.
7. Program and Event changes
We will use reasonable endeavours to deliver the Event as advertised. Dates, venues, rooms, speakers, presenters, session times, program content, social functions, tours and other details may change without liability where reasonably necessary.
Where practicable, we will arrange suitable substitutes and publish material changes on the Event website or communicate them by email. You are responsible for checking Event communications before attending.
8. Travel, accommodation, visas and insurance
You are responsible for your travel, accommodation, passport, visa, health and entry requirements and all related costs. Registration does not guarantee that a visa or other travel approval will be granted.
We recommend making flexible travel and accommodation arrangements and obtaining comprehensive insurance covering cancellation, loss of fees or deposits, travel disruption, medical and repatriation expenses, and loss of or damage to personal property.
Registration fees do not include insurance. Neither the Host nor the Conference Manager accepts responsibility for an attendee’s failure to obtain appropriate insurance.
9. Venue requirements and health and safety
You must comply with the entry conditions, health and safety requirements and lawful directions of each Event venue and its authorised personnel.
You must not attend an Event activity if doing so would breach an applicable public-health direction or create an unreasonable risk to others. You are responsible for notifying us promptly of accessibility, dietary or other requirements relevant to your safe participation.
We cannot guarantee an allergen-free environment. You remain responsible for managing your allergies and medical requirements and should seek information from venue or catering staff where necessary.
10. Conduct and refusal of entry
You must behave lawfully, respectfully and considerately; respect speakers and other attendees; consume alcohol responsibly; and refrain from harassment, discrimination, intimidation, offensive conduct, unsafe behaviour, nuisance or disruption.
You must not damage property, endanger any person, interfere with Event delivery or disregard a reasonable and lawful direction given by us, the Host, the Conference Manager or venue personnel.
Acting reasonably, we may refuse admission, remove a person from all or part of the Event, or cancel a registration for breach of these Terms and Conditions or other reasonable safety, security or conduct concerns. No refund will be payable where removal or cancellation results from the attendee’s breach, except where required by law.
11. Official photography, filming and recording
The Host may engage photographers, videographers, audio technicians, streaming providers and other service providers to document and communicate the Event.
By attending, you acknowledge that you may appear incidentally in photographs, video or audio recordings. We may use Event recordings for reporting, archival, educational and promotional purposes, including on websites, social media, email and materials promoting future events, without payment to you.
If you do not wish to be the identifiable subject of an official photograph or recording, notify us during registration or advise the registration desk and, where practicable, the photographer. We will take reasonable steps to honour your request, but cannot guarantee exclusion from crowd or background images.
You warrant that you have notified any guest or Relevant Person registered by you of this clause.
12. Attendee photography and recording
You may take photographs for personal, non-commercial use where this is not disruptive, intrusive, prohibited by a speaker or venue, or inconsistent with another person’s privacy or intellectual property rights.
You must obtain consent before making an identifiable person the principal subject of a photograph or recording.
You must not record, stream, reproduce or distribute presentations, sessions, slides, posters or other Event content without prior written permission from the relevant rights holder and the Host.
13. Intellectual property
All intellectual property rights in the Event and materials distributed at or in connection with it remain owned by the Host, sponsors, speakers, exhibitors or other applicable rights holders.
Unless expressly permitted by law or authorised in writing, you must not reproduce, modify, distribute, transmit, republish, display, perform, sell or commercially exploit Event content, trademarks, trade names or materials.
Nothing in these Terms and Conditions transfers intellectual property rights to you. Personal, non-commercial viewing and use of materials supplied to attendees is permitted only for the purpose and subject to any conditions stated by the rights holder.
14. Speakers, sponsors and other participants
Views expressed by speakers, delegates, exhibitors and sponsors are their own and do not necessarily represent the views of the Host or Conference Manager.
Each speaker, exhibitor and sponsor is responsible for their content, claims, advertising and materials. Inclusion in the Event does not amount to endorsement by the Host or Conference Manager.
15. Independent suppliers
Venues, accommodation providers, transport operators, caterers, audiovisual providers, entertainers and other suppliers provide their services as independent contractors unless expressly stated otherwise.
To the extent permitted by law, neither the Host nor the Conference Manager is liable for the independent acts or omissions of a supplier, attendee, speaker, exhibitor or sponsor. Any separate booking with a supplier may be subject to that supplier’s own terms and conditions.
16. Accessibility and special requirements
Please disclose accessibility, dietary or other participation requirements during registration or as soon as reasonably practicable. We will use reasonable endeavours to accommodate notified requirements but cannot guarantee that every request can be met.
Where a support person is required, contact us before registering so that admission arrangements and any applicable fee can be confirmed.
17. Disclaimer and limitation of liability
Information provided on the Event website or at the Event is general in nature and supplied in good faith. While reasonable efforts are made to keep it accurate and current, the Host does not warrant that it is complete, accurate, suitable for a particular purpose or free from error.
Nothing in these Terms and Conditions excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Subject to the preceding paragraph and to the extent permitted by law, the Host and Conference Manager exclude liability for indirect or consequential loss; loss of profit, revenue, opportunity, enjoyment or anticipated savings; and travel, accommodation or other external costs connected with the Event.
Where liability for goods or services can lawfully be limited, liability is limited, at our option, to replacement or repair of goods, resupply of services, or payment of the reasonable cost of doing so. For other loss, aggregate liability is limited to the amount you paid for the relevant registration, except to the extent the loss was directly caused by our negligence or where a different limit is required by law.
You are responsible for your personal property. To the extent permitted by law, the Host and Conference Manager are not responsible for theft, loss, destruction or damage occurring at the Event.
18. Your indemnity
To the extent permitted by law, you indemnify the Host and Conference Manager against losses, liabilities, costs and expenses reasonably incurred because of your unlawful, negligent or wrongful act or omission, your breach of these Terms and Conditions, or damage or injury caused by you.
This indemnity is reduced to the extent that the relevant loss was caused or contributed to by the negligence or wrongful act of the Host or Conference Manager.
19. Privacy
We collect personal information necessary to process registrations, administer and deliver the Event, communicate with attendees, manage safety, accessibility and dietary requirements, process payments, and meet legal and operational obligations.
We may disclose relevant information to the Host, Conference Manager, venues, accommodation providers, technology and registration providers, caterers, sponsors where you have consented, and other suppliers who need the information to deliver the Event.
Personal information will be handled in accordance with applicable privacy law, including the Australian Privacy Principles where they apply, and the FAMANZ Privacy Policy.
Where you provide another person’s information, you warrant that you have their authority to do so and have informed them of how their information will be handled.
20. Website use and viruses
You access the Event website, downloadable files and linked third-party sites at your own risk. We do not guarantee uninterrupted access or that the website or files are free from viruses or other harmful components.
To the extent permitted by law, the Host and Conference Manager are not responsible for damage or interference to data, hardware, software or systems arising from website use. Third-party websites are governed by their own terms and privacy practices.
21. Circumstances beyond reasonable control
Neither the Host nor the Conference Manager is liable for delay, disruption, change or failure to perform caused by circumstances beyond reasonable control, including natural disaster, severe weather, fire, flood, epidemic or pandemic, public-health emergency, war, terrorism, civil disturbance, industrial action, transport interruption, venue unavailability, utility or technology failure, government action or the illness or unavailability of a key presenter.
This clause does not remove any refund or other right expressly provided under clause 6 or any right that cannot lawfully be excluded.
22. Notices
Notices to you will be sent to the email address supplied during registration. You are responsible for keeping your contact information current and checking your email, including junk or spam folders.
Notices to us, including cancellations and transfer requests, must be sent to [email protected]. A notice received outside 9.00 am to 5.00 pm on a business day at the recipient’s location is treated as received on the next business day.
23. General
If any provision is invalid or unenforceable, it will be read down to the minimum extent necessary or severed without affecting the remaining provisions.
A failure or delay in enforcing a right is not a waiver of that right.
These Terms and Conditions, the registration information and any policies expressly incorporated by reference form the agreement concerning registration and attendance. If there is an inconsistency, these Terms and Conditions prevail unless expressly stated otherwise.
We may update these Terms and Conditions from time to time. The version accepted when you register will apply to your registration, except where a change is required by law or is reasonably necessary for safety or Event delivery and does not materially disadvantage you.
